Overall, in the CPS’ view, false allegations of rape are “serious but rare”. They estimate that there is one prosecution for a false rape claim out of every 161 rape cases prosecuted. That means — according to the best available data — false allegations make up 0.62 per cent of all rape cases.

Other statistics indicate 4% of accusations are false.
So while false accusations of rape do happen they are rare.   Obviously it would be better if it didn't happen at all, but it would be good if rape didn't happen at all.  Neither is going to not happen.

Actually, about 60% of rape cases are dropped because not enough evidence to convict, doesn't mean their fake but to say 4% is misleading

Statistics which which claim that the overwhelming majority of rape claims are not false are predicated upon the notion that claims "neither confirmed nor debunked" are not false. Therefore, the true number of false rape claims is likely much higher than 4%.

All claims should carry no penalty for the accused until the claim against him/her is proven in a court of law. That means no termination from work or school, nor severance of contract. The assumption of innocent until proven guilty should never be suspended under any circumstances, regardless of whether a large number of highly publicized cases in short succession were all proven true. Every person is entitled to due process, period.

We see the effect #MeToo is having at workplaces now. Male bosses are increasingly too afraid to associate behind closed doors with female coworkers, out of fear that a false charge will be levied against them one day. This carries the risk of denying women access to the social networks that facilitate career advancement opportunities.
In short, women are going to feel some heat for this current climate. I think that's good and proper. Because it'll mean everyone has a vested interest in finding a way out of this mess.

The right way forward is to re-establish clear rules of conduct, so that everyone knows how to act and what to expect in their dealings with people of the opposite sex (outside of family, of course).

Can you imagine living in a world where you were presumed innocent until proven guilty?

False allegations are far from victimless crimes. With a few high-profile exceptions, false allegations usually do not lead to wrongful conviction of the accused. However, they may lead to other serious consequences, such as pre-trial detention, loss of employment, intervention by social services, or death threats and other social stigma. False allegations often have a racial dimension and may disproportionately target black people. Worse still, false accusers collectively victimize all genuine victims of sexual assault by eroding their credibility. [LINK]

The problem is that you can't just make a special-pleading case for just one type of crime without making it apply to all accusations for all crimes.

Such a policy would effectively make it impossible for any poor person to accuse a wealthy person or corporation of any crime.

Instead of trying to punish people for seeking justice, why don't we better serve the accused in order to prevent their lives being destroyed.

Would you agree that people should be treated as de-facto innocent (not incarcerated or slandered in the press or inconvenienced in any way) until they are proven guilty in a court of law?

I don't think anyone is suggesting that false accusations are not a serious matter.    Rape is particulary awkward because often there is no actual evidence or witnesses.   It's often comes down to 'he said, she said'.

It's wrong if innocent people suffer because of a malicious false accusation, but its also wrong if a rape victim gets punished for 'false accusation' if the standard of proof reuired for a successful prosecution is not possible.

I can't see a simple solution.

Anyone accused of any crime is liable to be incarcerated ('remanded in custody') and inconvenienced pending their trial.  I am sure being falsely accused of rape can be very traumatic, but I don't see what 'the system' can do about it.

A similar thing happens with accusations of pedophilia.   The conseuences of a false accusation of pedophilia are probably worse than a false accusation of rape - you can't really give rapists the benefit of the doubt but deny it to pedophiles.

AFAIK, false accusation is an offence and anyone falsely accused can sue.  I don't see what else can be done.

You're right.  Filing a false police report is a crime.
