When a driver hits a pedestrian, often the biggest question is: Whose fault was the accident? Generally, fault is determined by the law of negligence. A person who fails to exercise a reasonable standard of care under the circumstances may be considered "negligent."
However, both the driver and the pedestrian can be at fault by being negligent. For example, the pedestrian may be crossing the street illegally while the driver is traveling in excess of the posted speed limit. This scenario is treated differently in different states.
Some states, such as Maryland and Virginia, follow what's called a "pure contributory negligence" rule. This means that if the pedestrian contributed in the slightest bit to the accident, then he and his auto insurance company cannot recover damages from the driver and his auto insurance company.
Other states follow a "comparative fault" rule. This means that a pedestrian can recover some damages even if he was partly at fault. [LINK]

Yes there are. They are the people who are materially rewarded far beyond their productive capacity or moral worth by corporate capitalism.
Or they're just spectacularly dumb or wrapped up in motivated reasoning. But there's a reason that people tend to 'grow out' of libertarianism: exposure to reality tarnishes the appeal of illusions. Which is why you didn't answer the question: you're still in the stage of your life where you can entertain the idea that capitalism is meritocratic without too much cognitive dissonance. My favorite stage is the next one, if nothing else then for the pure delicious irony of it: 'real capitalism has never been tried!'
This is also, incidentally, why you meet a lot of libertarians who work for the government: they think that the problems of scale and managerialism are unique to government, when they are a natural result of the capital accumulation which originally gave capitalism its name.
Socialism is the reason why China was far behind. Once the economy was capitalist, they were booming. Once they fix their government to democracy and capitalist, they will overtake US once they increase their foreign influence

University costs about 4-7000 a year and rents are cheap ! try that in the US without a Community college transfer !

The STEM approach is a start but making access and physical environments (schools) AWESOME ...not some shitty

China has several empty CITIES that can accomodate 2 to 5 million people ! 40 years ago Chinese were still walking
