Thank you for accepting my debate topic. As we all know the COVID-19 pandemic has taken the whole world by storm. 
It all started from a wet-market in Wuhan(supposedly), the argument against China can be made that it was slow in sharing infromation regarding the pandemic but fast in controlling the spread in it's own territory only after it had spread across various parts of the country. 
The doctors in the area were competent and already warned the government that they are seeing a surge in some form of contageous disease in the area. The government ridiculed the early whistle- blowers and downplayed the incident, as a result of that very critical information about
How contageous the virus was?
What were it's symptoms ?
How to treat the virus?
reached other countries far too late far too slow, and the delay caused  one of the biggest troubles in containing the virus, lack of public awareness.

Yes a lot of media publications were speculating it, but citizens will not believe media speculation. An official circular by Health Ministry of various govenments, only and only that can be taken as an absolute certain, concrete information by citizen of any country. The circulars never came because the countries themselves did not know. It is a medically established fact that corona virus has an incubation or latency period of 14 days, even then symptoms may or may not appear(asymptomatic cases).

All the tourists , all the chinese citizens became carriers of the virus unknowlingly and the disease spread all across the globe.


A further argument can be made the the transfer of critical information about the treatment, incubation period and other relevant information was not shared transperantly by the chinese government. The doctor who was made  the relevation is now dead[1], China should be held accountable for gross mismanagement of the situation and causing unecessary loss of life, but also trying to change narratives and blaming it on other countries.[2]
An attached report states that 430,000 people travelled to USA from China since the initial surfacing of the disease.[3] The results are infront of everyone USA is the worst affected country  in terms of death toll and total number of cases.

The most convicing argument that can be made against China lies in it's past not the present
This is not the first time a virus in the animal kingdom has jumped boundaries and successfully infected humans, the previous time it happened during 
2002-2004 was also in China, from the same Wetmarkets that have now been reopened[4]

If wetmarkets are really that dangerous could the virus have emerged from any other country?
Not really, China will continue to be the place from where such deadly viruses will continue to emerge because its wet markets are different from majority of the countries. While most countries eat only chicken,duck,pig,cow or goat meat,etc. The trade of these animals has been present in human civilization for millennials, thus these animals are slaughtered following due procedure and necessary precautions. On the other hand animals offered by China's wet markets, including the market in Wuhan, has included wolf cubs, civet cats, snakes, bats, pangolins, turtles, and many other species.[5]

Yes,wetmarkets exist in other countries too and some even deal with wild animals(in some South Asian countries like Vietnam,etc) ,a virus threat could have come from these countries but shear numbers and probability suggests China would have been the most probable source of a new virus outbreak mathamatically speaking.

THE 2002-2004 outbreak was also linked to the sale of wild animals in wet-market(specifically civet cats).
A national geographic reports states:The Huanan market(in Wuhan)had a wild animal section where live and slaughtered species were for sale: snakes, beavers,procupines, and baby crocodiles, among other animals.[6]

A fact worth noting is that even during the previous outbreak China did not allow it's media to report about the SARS outbreak and a WHO team on inspection was not allowed to enter the area for weeks.[7]
WHO even in this case was shown what the chinese wanted them to see and given a narrative suitable to chinese propaganda.

Even when there was an instance of a previous outbreak causing loss of life China failed to mend its way and resorted to a similar stratergy during the COVID-19 pandemic only this time the virus was far more deadly and a far more silent killer. 

Why cant international law's help?
China has always blatently violated any international law that defies its doctrine and been an oppressive,totalitarian state with little regard to human rights.
Any person reading this ,even CON would agree on this in the light of China's recent violations of marinetime laws by building artificial military islands within sovereign waters of other country.[8] which has been verified by Independent sources and by the US navy's presence in the  South China Sea.
Furthermore threatening to go to war if its claims are rejected.

Why would a country that does not respect international laws at all pay heed to any law now? They wont, to simply put it.

A Risk vs Benifit analysis post 2002-2004 SARS:

Benifit: A chinese person wants to eat a cat/crocodile/bat etc.

Risk: Potential outbreak of another virus that will be even more deadly than the SARS(2002-2004)

The world knows which way the Chinese went and as a result 323,000 lives have been lost. 

I ask a simple question to CON or any other reader:Does a Chinese person's urge to eat a wild animal come over the the lives of 323,000 lives that have been lost?(deaths increasing daily)

Accountability must come: US has on precious occassions sanctioned countries(Eg:- Iran for its nuclear programme and Russia for its arms sales) , similar sanctions
must be placed by other countries untill China relents to economic pressure and orders permanent closure of Wet-markets and apologises to the International community for the tremendous loss of life.

GOVERNMENT is "the system or group of people governing an organized community, often a state"

CHINA [officially the People's Republic of China; PRC] is "a country in East Asia.  It is the world's most populous country, with a population of around 1.428 billion in 2017. Governed by the Communist Party of China, the state exercises jurisdiction over 22 provinces, five autonomous regions, four direct-controlled municipalities, and the special administrative regions of Hong Kong and Macau"

ACCOUNTABLE [adj] is "obliged, when called upon, to answer (for one's deeds); answerable"

SPREAD [verb] is "to extend; to stretch out in varying or opposing directions"

COVID-19 is "an infectious disease caused by severe acute respiratory syndrome coronavirus 2. It was first identified in December 2019 in Wuhan, China, and has since spread globally, resulting in an ongoing pandemic"

BURDEN of PROOF:

Wikipedia advises:

"When two parties are in a discussion and one makes a claim that the other disputes, the one who makes the claim typically has a burden of proof to justify or substantiate that claim especially when it challenges a perceived status quo"

CON interprets the resolution to mean that PRO must prove the wisdom and benefit of some undefined coalition of governing bodies blaming China for the ongoing global pandemic and pursuing some undefined sanction as a matter of public policy

CON:IA.1:   IMMUNITY

  • CHINA is recognized as a sovereign state by 178 countries and as such enjoys full immunity from PRO's planned proscription
    • "The rule's wider implication is that a state and any sovereign, unless it chooses to waive its immunity, is immune to the jurisdiction of foreign courts and the enforcement of court orders. So jealously guarded is the law, traditionally the assertion of any such jurisdiction is considered impossible without the foreign power's consent"
    • "China has consistently claimed that a basic principle of international law is for states and their property to have absolute sovereign immunity.   • There is no international law governing the spread of infection diseases.  The closest thing we have to law is the International Health Regulations treaty of 2005 but that treaty has no provisions for laying blame or demanding compensation

      • Each State Party shall assess events occurring within its territory by using the decision instrument in Annex 2 [Which includes evidence of a SARS like disease]. Each State Party shall notify WHO, by the most efficient means of communication available, by way of the National IHR Focal Point, and within 24 hours of assessment of public health information, of all events which may constitute a public health emergency of international concern within its territory in accordance with the decision instrument, as well as any health measure implemented in response to those events
      •  Following a notification, a State Party shall continue to communicate to WHO timely, accurate and sufficiently detailed public health information available to it on the notified event, where possible including case definitions, laboratory results, source and type of the risk, number of cases and deaths, conditions affecting the spread of the disease and the health measures employed; and report, when necessary, the difficulties faced and support needed in responding to the potential public health emergency of international concern
        • We know that the Wuhan Municipal Health Commission sent out its first official message regarding the virus on Dec 30.  and we know that World Health Organization got its first heads up regarding the virus on Dec 31
          • The only agency with oversight regarding this agreement is the World Health Organization, who has expressed full satisfaction with China's compliance:
            • "We appreciate the seriousness with which China is taking this outbreak, especially the commitment from top leadership, and the transparency they have demonstrated, including sharing data and genetic sequence of the virus. WHO is working closely with the government on measures to understand the virus and limit transmission. WHO will keep working side-by-side with China and all other countries to protect health and keep people safe
    • According to China and WHO, China was in full compliance with the IHR.  No other international law is applicable or relevant
    • Since the WHO notified all member states of a potential SARS like disease on Dec 31, each member state is exclusively accountable for new cases in its state after Dec 31
    • PRO's only recourse is to establish some new framework in international law, which carries no force without Chinese ratification and China would never ratify a new treaty designed to blame China.
CON:IB.1: SCOPE

  • International law restricts reparations to injuries resulting from the wrongful act itself, not any knock on effects.
    •  "It is only injury caused by the internationally wrongful act of a State for which full reparation must be made. This phrase is used to make clear that the subject matter of reparation is, globally, the injury resulting from and ascribable to the wrongful act, rather than any and all consequences flowing from an internationally wrongful act"
      • That is, any sanction would also have to identify and prove specific individual harms.  Consider that most American cases of coronavirus came from Europe, not China:
        • "An investigation by The Intercept shows that travel from Europe was a key facilitator of the virus’s spread in the U.S. — a large amount of the first Covid-19 cases in the U.S. can be traced to Europe.  The Intercept reviewed hundreds of media reports detailing the first recorded coronavirus cases — known as the “index cases” — in U.S. states and territories. European travel preceded the index cases in at least 13 states and territories, compared to only six from China"
        • PRO's unidentified plaintiffs can only address cases directly attributable to China, rather than cases attributable to other government's insufficient responses after Dec 31
          • By Dec 31, China was only aware of 44 cases of unusual pneumonia, all Chinese citizens.
  • Even if PRO gets past China's sovereign immunity, international law prohibits any Chinese accountability for other govts' inaction after Dec 31
CON:1C:1: CHARGES

  • PRO has failed to offer charges that
    • clearly violate international law, and
    • are supported by hard evidence.

      • As a direct result of 2003 outbreak, the Wuhan Institute of Virology began working with WHO to build the first level IV biosafety lab in China, with the intention of acting as a lookout and warning beacon for future SARS like illnesses
        • In 2020, China's WHO team was not denied access.  Rather, it was China's WHO team who alerted the world to the coming pandemic
    • PRO has to show that China's response was somehow extraordinary in comparison to other national responses.  According to WHO, China's response was rapid and in full compliance
CON:1D:1: BENEFITS

  • Beyond the lack of venue or legitimate charges, PRO must also identify the advantages of investigating, charging, and sanctioning China
    • PRO argued that China censored media and barred investigators in 2003 while CON has showed that those past problems were resolved during the 2020 response.  Improved openness was a definite benefit to the global response in 2020.  If nations sanction China anyway, will China be more likely to improve openness in future?  Probably not

SUMMARY 

  • China is an easy scapegoat because the pandemic started there.  But China's only official and legal obligation was to notify WHO within 24 hours of confirming a SARS like disease.  According to China and WHO, China did exactly that.  Beyond this single international agreement, other governments have no legitimate cause, means, or motivation for holding China accountable for the present COVID outbreak.

Objections to CON's arguments in a chronological order:

1.Unilateral action by a sovereign state does not require the state to prove any breach of international conduct atleast if we are speaking about economic policies. Case in point American sanctions against China beginning in 2018.[1]

Benefit of the sanctions: No one in current world wants to undergo even more economic woes, but totalitarian actions causing harm to other sovereign states should be accounted for. China has only agreed to ban wildlife trade till the pandemic is over, meaning it is intending or may open wildlife trade afterwards. 
The umbrella PRO is suggesting is that of zoonotic diseases not covered by many international laws, because laws are made sometimes as a preventive measure sometimes as a response to a catastrophe. Case in point stringent gun laws in UK, New Zealand ,and most recently Canada came only after mass shootings. In light of the recent pandemic PRO's argument is simple:

A comparison to Chernobyl incedent can be very well be made, if mismanagement is not a crime then Soviet Union should not have been held accountable for defects in their RBMK reactors and Japan for the Fukushima incident.South China Morning Post terms these wetmarkets as " perfect incubators of the next deadly virus".[2]

Providing an argument that China should not be held accountable as it reported a disease,even by CON's report which was just pneunomia like, is same as saying if Soviet Union had reported it's incident it could have waver off any responsibility of the plants. Same as saying we will report it to the UN but not the neighbouring countries who might be at potential risk and any damages caused to them by the concerned state is not to be held accountable because a prior notification was given.


Even in CON's report it specificies and I am quoting CON here:

Has CON furnished any report stating China shared case definitions, lab results and types of risk? and most importantly conditions affecting the spread of disease?




Mismanagement might not be a crime but reckless endangerment causing or amounting to death is, as is causing death by neglect. Wet markets in China were no less dangerous than the nuclear reactors of the erestwhile Soviet Union.PRO claim is based on the evidence, and in response to CON's query, PRO wants to make itself absolutely clear , most countries ban the sale of wildlife animals for purposes of consumption. PRO is a citizen of India, in India sale or consumption being liable to criminal proceedings by Wildlife protection act,1972.[3]

Not only India , a host of other countries also ban the sale of wildlife animals and the animals slaughtered are domesticated animals[5] not wild animals, CON has confused the two terms it seems.PRO has taken the curtsy to attach a report showing which meats are consumed most in the USA.[7] Thus the spread of zoonotic diseases developing from other countries is minimal. China and some African countries(because of bush meat consumption[4] can only be the potential sources, other countries follow strict regulations preventing spread of such diseases. 

contradictions are present in African and Chinese case:
In Africa bushmeat[6] is consumed because of poverty, in China it is consumed as a luxury. To elucidate Ebola and HIV are other zoonotic diseases caused by meat consumption of wild animals, COVID-19 being the newest. 


Conclusion:
If China is not forced to stop the sale of Wild animals , even more newer and far more dangerous viruses will jump from the animal kingdom to infect the human race and the result would be even more catastrophic than the one caused by COVID-19.

    • But that's not holding China accountable.  Let's remember we defined ACCOUNTABLE as "obliged, when called upon, to answer (for one's deeds); answerable"  Yes, States can drop sanctions on one another at will but that action places no obligation of the subject to answer or apologize or improve.  Without some international framework for impartial fact-finding, PRO is blaming China without concern for the truth and that's not accountability, that is scapegoating.

    • the USSR was never held to account for Chernobyl.  Here is a 1987 Penn State International Law Review article illustrating the weakness of international accountability

    • PRO dropped CON's argument that forced accountability might inhibit Chinese response to future pandemics
  • PRO argues that "forcing" China to stop selling wildlife will prevent future disease but this seems unlikely.  Human diseases emerge all over the world from many venues.  Respecting Chinese sovereignty means that the Chinese government should regulate Chinese commerce, not a coalition of foreign powers hypocritically ignoring their own disease vectors.

Objections to CON's details in chronological order: 

1.Previously CON had sited a report by an online media publication stating most cases came from Europe and not China.

PRO's objection: PRO is not questioning the integrity of the journalist and the media outlet reporting this but merely stating how can a journalist investigation be held to account as proof, they are not experts in the field( an epidemiologist). Without first hand reports by medical experts reinstating the fact this point is Null and Void.


2.Chinese reports in WHO database springs up after Feb 2, Feb 2 being the first data of publication of an article, that too was not relating to any of the facts PRO had asked about, not covering

"a State Party shall continue to communicate to WHO timely, accurate and sufficiently detailed public health information available to it on the notified event, where possible including case definitions, laboratory results, source and type of the risk, number of cases and deaths, conditions affecting the spread of the disease and the health measures employed; and report, when necessary, the difficulties faced and support needed in responding to the potential public health emergency of international concern" 

NOTE: PRO has used CON's source to investigate, in this case source being the WHO database. 

but was a pediatric study about children and the effect it has on them.
A).[Facing the pandemic of 2019 novel coronavirus infections: the pediatric perspectives]

Only at the 12th report could PRO find any relevance to the COVID-19 pandemic spread rest all dealt with hospital management and case analysis:
[Urgent research agenda for the novel coronavirus epidemic: transmission and non-pharmaceutical mitigation strategies]
 
Even then it only discusses possible stratergies does not identify any framework or concrete proofs that other States could act upon.

By that time total number of World cases had already crossed 40,000 cases across the world with reports of confirmed COVID-19 cases emerging in countries most across the world,clearing indicating that China's reponse was delayed and spread of critical information was blocked. 

PROOF: Why did reports started springing up suprisingly only after Feb 2, these reports are not from International journals which have a review period of generally one month or more. A person holding a professional degree can publish articles relating to his/her field, and articles cropping up suddenly after Feb 2 only suggests, State involvement is delaying of release of articles. Normally in an typical database search be it Elvesier or ScienceDirect( both one of the leading sources of Academically peer reviewed Data and research papers) variation is weeks even months, between subsequent articles.

3.Calling China's response massive and unprecented: 400 reports is a number, A lot of them are germane to the current situation a lot them not. 
Example:- 
[Suggestions for prevention of 2019 novel coronavirus infection in otolaryngology head and neck surgery medical staff].

4.Even PRO is an undergrad in a Science discipline, PRO understands the difficulty of conducting a scientific experiment but all science students can agree that small experiment might take at best a month to perfrom not more than that. So 3 months delay by hand of a PhD holder in a field is seriously questionable.



CONCLUSION: It becomes more than certain that springing up of reports only after Feb2 in unprecendented manner suggecting a delay caused by State involvement. Even the reports being published by China are not in accordance to what we would call a quick response, and data was infact blocked from reaching other countries. This holds grounds for calling China a perpetrator for spread of COVID-19.

The term international journal was only used to state how difficult it is to be published in one, and in context that the procedure is usually delayed because of the review period(one month or more). Only suggesting that any person holding a professional degree can publish an article, his or her professional degree gives credence to the report. Context of the entire paragraph was about timeframe, any reader can tell it. 

No where have I demanded reports being published in Elvesior or ScienceDirect, just mentioned them as example of research databases. 
I can and will happily cede the point about Feb 2, CON does not need to twist my words to win , many more places there are similar encroachments , I dont want to bring them up.]

PRO read the reports attached, finds it hard to believe how can it's writer be so careless, India's North Eastern states are very prone to terrorist activity, law enforcement fails to keep  people safe even from abductions and murder, father of a PRO'd friend was abducted in Assam by terrorists, thus wildlife trading in North East would not be the concern of authorities .All the above mentioned regions have had terror activities. Even when law enforcement enters rural areas in the above mentioned area they enter in numbers and in armoured vehicles, even then ambushes happen. Even if we consider 4000 turtles in a year is nothing compared to a China's well established 150 billion yuan wildlife industry. Its like comparing an algae to a Blue whale. 

PRO is stating the above facts just to provide some clarity as to how drastically different situations are in both countries context. 
Same case is in Africa people eat bush meat because they are poor and dont have money.

PRO's response: It is well established, but PRO would like to reiterate wildlife trade in the developed world, as most of the other parts of the world except few parts in Africa is almost non existent atleast for consumption purposes. 

Following questions should be addressed: 
Even after the SARS-Cov2 in 2002 the industry scaled by more than 50 billion yuans, thus instead of banning wildlife trade even after the virus outbreak.
When you know an industry has the potential to cause virus outbreaks in the human world, still to harbour it and grow it to unprecedented scales is unknown to the human world .
PRO is confidently challenging CON, cite one country with  trade of wildlife animals involving wet markets challenging China's scale of operations and the scale of their negligence. If he cannot cede the point that If markets reopen a future outbreak will probably happen in China, with Chinese government ignoring all the signs.
Its like distributing Nuclear ICBM launch codes as wifi passwords. 
When the Austrian heir was killed by Serbian underground organization,the Austrians did not go for impartial fault finding, they gave Serbia an ultimatum of war.
