I'm going to reapply this as it's a universal formula and setup for the foundation of constituting "should". That is what should be and should not be based on just natural law, let alone man made law and personal opinion.

Following that which is the cause or purpose connects the two.

Presenting this example again and for those concerned about SOURCES, pay attention. My inhaling these fatal toxic fumes , I should be dead. The effect following the cause logical follows and necessitates.

The United States once more has a government called the United States government or affectionately "Uncle Sam".

This government has democracy to vote in elected officials to orchestrate the legality process. This government has democracy which in turn via those elected parties or directly through petition, vote in on laws.

There's a whole legislature, congress to pass or veto laws.

Whatever laws that are passed by the United States government should in fact be legal.

That's just simply what it would mean.

Something shouldn't be illegal and that thing is legally passed. It doesn't compute. These are opposite.

The laws put in effect via congressional, legislative, political arenas, that process ,the cause should be legally in effect as that what it means to put them in effect.

A vote, a pass on a law should be a legalized law because it would of meant the government has passed it.

Any law passed, Jim Crow, segregation, purge, sundown towns, whatever, should be legal because something happened called the "passing of that law".

  • We are not debating whether or not a law should be illegal, we are debating whether or not passing laws segregation should be illegal. Regardless segregation should in fact be illegal because they violate the civil rights act. In addition, people are endowed with the rights of life liberty and the pursuit of happiness which segregation in public schools would violate. I don't see any argument from Mall against the resolution. 
  • You can legally pass something that should be illegal, but we are debating whether or not this should be legal, not whether making laws should be legal. Mall has thus not made a case for his position.
