Marriage is not merely a cultural or religious symbol; it is a legal institution that grants partners rights to inheritance, hospital visitation, insurance, adoption, and social legitimacy. Denying these rights to queer couples creates a class of second-grade citizens, violating Article 14 of the Indian Constitution, which guarantees equality before the law.
Consider this: sati pratha was once defended on religious and cultural grounds. Yet society evolved, recognizing that no tradition, however ancient, should override human rights. In the same way, denying same-sex marriage under the statement of culture is a refusal to evolve. As a progressive democracy, we must not let tradition become a tool for exclusion.
